1. Acceptance of Terms

By accessing or using the website of The Discovery Atelier ("Site," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use this Site. These Terms apply to all visitors, users, and others who access the Site.

2. Description of the Site

This Site provides information about The Discovery Atelier, a private bilingual Montessori preschool in Mooresville, North Carolina, and facilitates enrollment inquiries and waitlist registrations for our educational programs. The Site is intended for use by parents, guardians, and prospective families.

3. Eligibility

This Site is intended for use by adults (18 years of age or older) who are parents or legal guardians. By using this Site to submit an enrollment application, you represent that:

  • You are at least 18 years of age
  • You are the parent or legal guardian of any child whose information you provide
  • You have the legal authority to consent to the collection and use of your child's personal information
  • All information you provide is accurate, current, and complete

4. Enrollment Applications

4.1 Application Process

Submitting an enrollment application through this Site does not guarantee admission to The Discovery Atelier. All applications are reviewed by our admissions team, and admission decisions are made at our sole discretion based on available spaces, program fit, and other factors.

4.2 Waitlist

Joining the waitlist does not guarantee a spot in any current or future cohort. Waitlist placement indicates interest only. We will contact waitlisted families as spaces become available.

4.3 Priority Reserve Deposit

A $500 Priority Reserve deposit holds your position in the application queue. This deposit is:

  • Applied in full toward your first month's tuition upon enrollment
  • Fully refundable if your application is not accepted
  • Fully refundable within 30 days of written acceptance if you choose not to enroll
  • Non-refundable if you withdraw after 30 days of acceptance

Payment processing for deposits is handled separately and is subject to additional payment terms provided at the time of payment.

4.4 Founding Member Annual Prepayment

Founding Member annual prepayments are subject to the following:

  • Full refund available within 14 days of the school year commencing (Two-Week Happiness Guarantee)
  • Prorated refund available for withdrawals within 30 days of commencement
  • Our standard enrollment agreement governs all terms beyond this initial period

A formal Enrollment Agreement will be provided separately upon acceptance and must be signed before enrollment is confirmed. The Enrollment Agreement governs all tuition, fee, withdrawal, and refund terms for enrolled students.

5. Accuracy of Information

We make reasonable efforts to ensure the information on this Site is accurate and up to date. However, we make no representations or warranties of any kind — express or implied — about the completeness, accuracy, reliability, suitability, or availability of the Site or its content. Tuition, fees, program offerings, and availability are subject to change. Please contact us directly to confirm current pricing and availability before making any financial decisions.

6. Intellectual Property

All content on this Site — including text, graphics, logos, images, and the compilation of all content — is the property of The Discovery Atelier and is protected by applicable U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, transmit, or use any content from this Site for commercial purposes without our prior written consent.

You may print or download content for your personal, non-commercial use only.

7. User Conduct

You agree not to use this Site to:

  • Provide false, inaccurate, or misleading information
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to any portion of the Site
  • Transmit any harmful, offensive, or disruptive content
  • Violate any applicable local, state, national, or international law
  • Use automated means (bots, scrapers) to access or extract data from the Site

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DISCOVERY ATELIER AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from your use of this Site shall not exceed the amount you paid to us, if any, in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless The Discovery Atelier and its owners, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be submitted to binding arbitration in Mooresville, North Carolina, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for any actual or threatened breach of intellectual property rights.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
